The use of direction finding and GPS transmitters is prohibited and is considered a criminal offense. There was already a corresponding judgment (Az. 1 StR 32/13) by the Federal Court of Justice in 2013. Exceptions apply to a few cases and, in accordance with Section 100 f of the Code of Criminal Procedure, require an order by a judge. Only if there is imminent danger can this also be done by the public prosecutor or the police. Nevertheless, it happens again and again that suspicious spouses or company bosses use eavesdropping devices. Even criminals and fraudsters do not shy away from using them.
No wiretapping without a valid reason
The above judge order applies only to the listening and recording of non-public statements made by a suspect outside of an apartment. The basic requirement is that he is suspected of a serious crime. In addition, other investigations must not be very promising or must be significantly more difficult. Possible crimes for which a so-called minor eavesdropping can be ordered by a judge include:
- Gang theft
- sexual abuse of children
There is also the large eavesdropping attack, which, according to § 100 c StPO, is only possible in the case of particularly serious acts and disproportionately difficult investigations. The surveillance of telecommunications is subject to similarly strict requirements according to Section 100a of the Criminal Code.
Problem-free acquisition of eavesdropping devices
The illegal use of eavesdropping devices is made easy for us humans. For example, baby monitors are also included, which can of course be purchased without any problems. The same goes for GSM bugs. Some parents prefer this to the classic variant because they have a much greater range. Due to the fact that many eavesdropping devices can also be used legally, they are sold to every customer without restriction.
Even if digitization goes hand in hand with countless advantages for our private and professional life, it also harbors many new risks. Unfortunately, hacker attacks are no longer uncommon these days. Not only state institutions such as ministries are affected, but also numerous private individuals. Just as cybercrime is spreading more and more, there are also increasing numbers of illegal use of eavesdropping devices.
GPS monitoring in the car
Whether jealous spouses or suspicious company bosses, they often decide to use GPS trackers to secretly locate vehicles. The small devices are uncomplicated to use, as a rule they contain a SIM card for signal transmission. They provide detailed information about the position of the car around the clock. However, there are many other alternative objects for placement in a car, including:
- GSM bugs
- Tracking device
- Cell phone with GPS
Secure detection of eavesdropping devices by detective agencies
Anyone who suspects they have been bugged is faced with a great challenge as a layperson. It is extremely rare that tampering is detected on a vehicle. In particular, users of eavesdropping devices who are familiar with the subject often have a wealth of sophisticated methods at their disposal. Attaching a tiny GPS tracker in the wheel arch, on the tank or the underbody of the car, as we know it from television or the cinema, is out. Even a thorough, visual search in the classic hiding spots therefore often does not produce a positive result.
It is particularly difficult when GPS trackers have been connected to the electrical system of a vehicle. With a little experience, this process can be completed in a few minutes, and seekers have little chance of discovering it. If you have a well-founded suspicion, you should, for example, consider the Lentz detective agency with your detective agency in Stuttgart. Professional employees have the option of using the latest technology, such as special search and mobile X-ray devices and endoscope cameras, to completely x-ray cars. If a GPS tracker is installed, it will be discovered this way with certainty.
Are bug finders helpful?
There are bug finders in the trade, but for which you have to put a relatively large amount of money on the table. They are criticized by many experts, and some manufacturers are even described by them as charlatans. Those who rely on them are often left – that is, in this case, a negative result makes you feel safe, but every spoken word is listened to. It is not considered to be a serious counter-eavesdropping.
With a bug finder, only a small part of the eavesdropping devices available on the market can be found. There is therefore no guarantee that living spaces and co. Are actually completely free of such products. A competent detective agency also uses bug finders in some cases, but they are only one component of a large number of alternatives. This means that if it indicates that there are no bugs, further sophisticated systems are used that guarantee the highest possible level of security against eavesdropping.
First steps to find eavesdropping devices on your own
The involvement of a detective agency guarantees the best results, but everyone can initially pay attention to different things. Anyone who feels overheard has the following options:
- strange noises – not all eavesdropping devices work silently; they may be accompanied by a click or a low whirring sound; at best, concentrate on unusual noises in the evening or at night
- unknown objects – the focus should be on lamps, smoke alarms and the like, as well as on decorations and objects that appear out of place; cables that seem to lead nowhere should also be examined more closely
- RF detector – It searches for radio waves and guides searchers to possible transmission devices such as microphones; if you approach a “bugged” project, it indicates this with a sound
